Terms of Use and Privacy Policy – Fox Group

("Terms of Use")

This document constitutes the privacy policy of the entire Fox Group, including customer clubs and the e-commerce websites of the various brands.


The following document includes several changes from the previous version of the Group’s privacy policy and terms of use, including matters relating to the collection and provision of personal information by the Group (including through automated tools), the use of external analytics tools, the manner in which information is used, and the circumstances in which information may be shared with third parties, all as detailed below.
Your first access to or use of any of the Group’s digital assets constitutes consent to the provisions of these Terms of Use.


A. Privacy Policy

1. General

1.1. Fox Group (“the Group”) respects the privacy of its users, customers, and all individuals using the services it offers and provides (“Users”) through the Group’s digital assets and related services, including websites, applications, smart devices containing IoT (Internet of Things) technology, and customer clubs (the “Digital Assets”). The Group attaches great importance to protecting the privacy of its users and is committed to safeguarding the personal information users share with the Group, acting in accordance with this privacy policy and applicable law.

1.2. The list of companies in the Group is available at: https://capsu.link/vqxNoR, and this policy applies to all of them accordingly.

1.3. The Group respects its users’ privacy and is committed to adhering to the accepted privacy protection standards in Israel. Personal information provided by users or collected about them will be used solely in accordance with this privacy policy or as permitted by law.

1.4. For the purposes of this privacy policy, “Personal Information” means any identifying information about users that is provided or collected about them through the use of the Digital Assets, including for the purpose of registering for services offered, as well as any identifying information about their use of the Digital Assets.

1.5. The Group believes that users have the full right to know its policies and procedures regarding the collection and use of information provided by them or collected about them through the use of the Digital Assets. The purpose of this privacy policy is, among other things, to explain the Group’s procedures regarding users’ privacy and how the Group uses personal information provided by users or collected about them as part of their visits to and use of the Digital Assets.

1.6. Users should note that this privacy policy applies to all of the Group’s Digital Assets; however, in certain specific activities or services, additional or different rules may apply, and a specific policy regarding the collection, provision, and use of personal information may be published alongside them.

1.7. Access to or first use of any of the Group’s Digital Assets constitutes consent to the provisions of this policy, including by approving registration for any service within the Group’s Digital Assets, and includes consent for the collection, management, processing, storage, and other uses of information as described in this privacy policy. If the user does not agree to these terms, they must immediately refrain from further access to and use of the Digital Assets.

1.8. This policy is intended for all genders, and masculine language is used solely for convenience.


2. What Information Do We Collect?

2.1. The Group collects, receives, and stores the following types of information regarding users of the Digital Assets:

2.1.1. Technical Information

Information available to the Group and/or provided by users in the course of using the Digital Assets and the services offered through them, including before identifying as a registered user. This includes:

  • User behavior information – such as patterns of activity within the Digital Assets, browsing times, navigation paths, page and product visits, and usage habits of smart products (e.g., IoT devices) before, during, and after visiting the Digital Assets.
  • User device information – such as IP address (depending on the network, computer, or mobile device used to access the Digital Assets), device ID, browser type, and information about geographic location, whether the device or its components are active or inactive, subject to the device’s settings.

2.1.2. Information That Requires Registration

Some of the services provided within the Digital Assets require registration and the collection of personal information, whether during access to or use of the Digital Assets, or at the start and during the course of engagement. The Group, and any third party acting on its behalf to collect information, gathers, manages, and stores personal information provided by users consciously and voluntarily during their use of the Digital Assets and the services offered therein.

This personal information may be collected from details users provide when placing an order, contacting the Group, registering and creating a personal account, receiving service, participating in activities, joining customer clubs, or any other voluntary process or service chosen during use of the Digital Assets, whether or not the user fully completed and submitted the relevant forms.

Such information may include:

  • Personal details such as full name, contact details (mobile phone and email), home address, ID number, date of birth, gender, marital status, and in certain cases, wedding date and expected birth dates.
  • Self-checkout services – information necessary to complete a transaction, including purchased product details (type, price, quantity), purchase date, and payment method details (without storing full credit card data). For security and theft prevention, the self-checkout area is recorded by security cameras, with footage retained for a limited period as permitted by law. When using a membership card, additional information is collected to identify the customer and tailor benefits. The system also logs technical data regarding use of the checkout for security and service improvement.
  • Transaction and service information – including order details, purchased products, prices, discounts used, returns and exchanges, credits, communications with customer service representatives, calls, recordings, surveys, inquiries, incomplete transactions (e.g., partially filled order forms), payment methods issued by the Group (including digital wallets), and any other information related to use of the Digital Assets and related services.
  • Customer club membership data – such as membership registration details, points accumulation, benefits usage, purchase dates, store locations, and buying preferences.
  • Third-party partnerships – in the context of using third-party services or campaigns that have business relationships with the Group, such as joint customer clubs, co-branded credit cards, and other commercial collaborations, including any information received from such third parties.

2.2. If a user chooses to provide information by granting access to their Google, LinkedIn, Facebook, or other social media account ("Social Networks"), they give the Group permission to obtain information from these networks, subject to the user’s settings on such platforms and/or their privacy policies.

2.3. If a user shares personal information with the Group about third parties (e.g., family or friends for gift purposes), the user must inform those parties before providing such information to the Group and obtain their consent to both the provision and the intended use of the data in accordance with this privacy policy.

2.4. This policy applies only to "Personal Information" as defined in the Israeli Privacy Protection Law, 1981. Non-identifiable or aggregated information collected about users may be used by the Group for any purpose.

2.5. Users acknowledge that most of the information they provide or that is collected about them is not required by law, and is given voluntarily—among other reasons, so the Group can provide certain services. They agree that the Group may store this information in its databases as described in this policy. However, without providing some of this information, users may be unable to join the Digital Assets or enjoy certain services. For example, failure to provide required personal information (such as contact details, address, or payment method) may prevent registration, ordering, receiving invoices, joining customer clubs, or enjoying personalized benefits. Blocking cookies may impair functionality and personalization, and refusing technologies used in self-checkout systems may prevent their use.

3. How We Use the Information

3.1. The Group, and entities engaged in data processing on its behalf, use non-personal information (which does not personally identify users) for statistical, analytical, and research purposes; for customizing, developing, optimizing, and improving the Digital Assets and the services offered through them; and for the Group’s marketing and commercial purposes.

3.2. The Group, and entities acting on its behalf, use personal information in accordance with this policy, including for:

  • Managing and operating the Digital Assets and the services offered;
  • Providing the range of services offered by or on behalf of the Group, including through service providers assisting in their operation;
  • Customizing, developing, and improving the Digital Assets and services, including creating services tailored to user needs and expectations, modifying or discontinuing existing services, developing and training machine learning models, and using other technologies for research and development;
  • Responding to inquiries, providing technical support, conducting surveys, handling requests, and maintaining contact;
  • Making decisions—manually or automatically—regarding users or other parties, including evaluating applications to engage with the Group, risk management, and conducting surveys;
  • Sending operational messages and notifications via email, SMS, push notifications, and other channels regarding services provided, authentication, password recovery, surveys, deliveries, cart reminders, confirmations, and similar;
  • Sending marketing materials and promotions from the Group or its partners via any communication method (subject to user consent, with opt-out available);
  • Deriving additional information and profiles from existing data, including interests, personality traits, and preferences, for service and marketing purposes;
  • Personalizing advertisements on the Digital Assets and other online platforms;
  • Issuing and sending digital documents such as order confirmations, receipts, invoices, and satisfaction surveys;
  • Complying with legal requirements, court orders, or requests from authorized bodies;
  • Detecting, preventing, or addressing illegal or unauthorized use of the Digital Assets and related services;
  • Using AI technologies for analytics, marketing, and operational automation;
  • Processing payments in self-checkout stations;
  • Any other purpose permitted by law or detailed in this policy.

3.3. These data processors act solely on behalf of the Group and may include service providers, cloud platforms, and business partners.

3.4. To register and use a personal account, users may be required to provide details such as ID number, username, membership number, and password, and are responsible for maintaining their confidentiality.

3.5. Users confirm that all provided or collected information is accurate and that they use the Digital Assets on their own behalf unless explicitly authorized otherwise in writing.

3.6. Users consent to the transfer of their personal information outside Israel, including to Group owners, even to countries without equivalent privacy protection laws.

3.7. Information will be stored as long as the Group deems necessary for its purposes. The Group may record customer service calls and store correspondence for quality control and documentation.


4. Transfer of Information to Third Parties

4.1. The Group will not share personal information with third parties without consent, except as described in this policy, including:

  • With user consent;
  • As needed for the services offered, including via service providers;
  • With business partners and other Group companies;
  • For “Dream Card” holders, with the card issuer;
  • To respond to service requests;
  • To enforce this policy or the Terms of Use;
  • To detect, prevent, or address fraud, abuse, security, or technical issues;
  • To comply with legal obligations;
  • To prevent harm to the Group, users, or others;
  • In case of business transfers, negotiations, or restructuring;
  • With Group-owned entities for management and oversight;
  • If the data is statistical/aggregated and non-identifiable.

5. Data Collection Technologies

5.1 When using the Digital Assets, including through the Group’s marketing campaigns on social networks, the Group may use automated tools and technologies such as tags, beacons, SDKs, pixel tags, and the like, as well as cookies (“Cookies”), through which information may be collected and stored about user activity on the Digital Assets or on other websites.

5.2 Cookies and pixels, in general, are small text files, tiny graphic images, and code snippets that the users’ browser or platform generates upon instruction, which are placed on the pages of the Digital Assets and enable identification of whether a certain action has taken place. When the user accesses the Digital Assets and/or any of the services offered within them, the cookies and pixels generate a message about this activity.
Cookies and pixels are used to collect information and allow the Group to measure responses to activities offered on the pages of the Digital Assets, improve and secure them, prevent fraud, etc.
Some cookies and pixels will expire when the relevant browser or application is closed, while others are stored in the user’s platform memory or sent to the Group, including to service providers acting on behalf of and for the Group, and even to the user’s own providers, for the purpose of providing the services available within the Digital Assets. The Group or third parties operating the cookies and pixels may from time to time access the content stored in them, which may be stored on their servers.

5.3 The Digital Assets use cookies and pixels to profile usage and improve the user experience, by collecting data. These tools collect information about the use of the Digital Assets. This information includes, among other things, details of the users’ internet service provider, IP address, the location of the device used to access the Digital Assets, the times and methods of use of the Digital Assets, the type of browser, and other anonymous details indicating the manner of use of the Digital Assets. To the extent that personal information is collected via cookies and pixels, it will be subject to the provisions of this Privacy Policy, and the Group may use it accordingly.

5.4 Some cookies and pixels are stored on the device and allow the Group to enable certain features automatically, as well as to facilitate and simplify the user experience on the Digital Assets and the services offered within them.

5.5 Cookies and pixel files help track visitors’ preferences and improve the user experience on the Digital Assets. For example, cookies and pixels allow saving the details entered by users into various forms, thus saving the need to re-enter them during the next visit, or identifying users’ preferred products in order to display offers and recommendations.

5.6 Within the Digital Assets, users’ information is collected and used via various advertising tools from third-party advertising companies embedded in the Digital Assets. The Group may share such user information with these third-party advertising companies and may also receive such information from them, for the purposes set out in Section 3 of this Privacy Policy above.
For example, the Group uses cookies and pixels from Google, such as those embedded via Google Analytics, AdSense, and/or DoubleClick, as well as tools from Facebook and several other services that are updated from time to time. These tools are used for delivering advertising content and remarketing across the web, which may be tailored to your preferences based on user activity patterns across the internet. In operating these tools, the companies providing them use their own tracking technologies and collect information such as IP address, unique identifiers of the device from which the user is browsing and its characteristics, online activity, pages viewed, and more
.

5.7 In addition, we may use third-party cookies such as those from Taboola and Outbrain, through which information may be shared for the purpose of creating Custom Audiences and Lookalike Audiences. This use helps tailor relevant content and advertisements. The use of this information is subject to the terms of use of the relevant providers, and you may manage your preferences in this regard at any time.

5.8 These are third-party services, and the Group is not responsible for them. If users wish to learn about the use these companies make of tracking technologies and the information collected through them, they can do so on their official websites. For your convenience, some of the links are provided here:

5.9 The Group uses digital analytics and measurement tools, including Business Intelligence systems, for data analysis and generating business insights. These tools help better understand customer needs, improve products and services, and adapt the business strategy.

5.10 Most cookies can be disabled. For example, most internet browsers allow users to delete cookies from their device, block the acceptance of cookies, or receive alerts before cookies are stored. However, it should be clarified that deleting cookies from the browser or from the user’s platform memory will not delete information and content already transferred to the Group or to third parties via them.
It should be noted that if the user deletes cookies or does not allow their storage, their online experience in the Digital Assets may be affected, including in relation to the ability to provide the services offered within them. Users are encouraged to review the instructions in their browser or “help” screen to learn more about
these functions.

5.11 By consenting to the terms of this Privacy Policy, you agree to the use of the technologies described and other technologies, as may be updated from time to time, for similar purposes, including the use of information collected through them to identify and/or profile you accordingly. If you do not agree, please update your device or browser settings as per your preferences as described above.

 


6. Marketing Communications

6.1. The Group may send marketing messages via email, SMS, WhatsApp, push notifications, or other methods, subject to user consent.

6.2. Users may withdraw consent at any time by following unsubscribe instructions in each message or contacting customer service.

6.3. Different brands in the Group may have separate marketing processes, and withdrawal of consent must be performed separately for each brand.



7. Access Permissions

7.1 For the purpose of carrying out certain activities and actions, including within the framework of certain services offered on some of the platforms within the Group’s Digital Assets, access may be requested to specific services on users’ devices.
These permissions include, among others:

  • Camera and Gallery – for example, for taking and uploading photos and documents, scanning barcodes;
  • Location Services – for example, for receiving offers and information relevant to the user’s location, including in relation to services offered within the Digital Assets;
  • Account Access – for example, for logging into certain Digital Assets using user accounts such as Google, Facebook, Gmail, and similar;
  • Calendar – for example, for creating reminders for events/meetings;
  • Push Notifications – for example, for receiving alerts and operational updates about various actions performed in the Digital Assets and/or regarding certain services offered within them that may be of interest to users;
  • Device Identification/Identity Data – for example, for creating a unique identifier upon entering, registering, and using the Digital Assets.

7.2 Users are not obligated to grant access to such services, and they may disable or prevent access via their device settings. However, restricting access to these services may limit users’ ability to fully enjoy the features and services offered within the Digital Assets.


8. Other Platforms

The Digital Assets, including the services offered within them, may contain links to various platforms (such as pages, websites, applications, and the like) on the internet that are not operated or managed by the Group, including to activities and services offered by such platforms.
The Group does not control or monitor the activities of these platforms, and the fact that they are linked to via the Digital Assets does not constitute the Group’s approval of their content, nor does it serve as a guarantee of their reliability, timeliness, or legality.
Any use made of such platforms is the sole responsibility of the users.
Use of these platforms is subject solely to the terms of use and privacy policy appearing on them, if any, and users are therefore advised to review these documents before making any use of such platforms.


 

9. User Rights

Users are entitled, in accordance with applicable law, to review personal information held about them by the Group, and, if they find that such information is incorrect, incomplete, unclear, or outdated, they may request that it be corrected or deleted.
Such requests should be submitted in writing to the Group via the email address: privacytx@terminalx.com (or any other address the Group may publish from time to time for this purpose).

The Group will make a reasonable effort to comply with such requests, in accordance with the provisions of the law.


10. Data Security

10.1 Reasonable efforts have been invested in the Digital Assets to maintain information security, including through technological mechanisms and systems designed to help protect against information leakage, unauthorized access and use, as well as the transfer, disclosure, copying, or deletion of information.
While these efforts may reduce existing risks, it is not possible to guarantee that the Digital Assets will be completely immune to such activities, and no liability shall be assumed for any damage caused to users or anyone on their behalf as a result thereof.

10.2 Users acknowledge that there is always some degree of risk in services based on data processing, especially during transmission over the internet. They agree to provide and have their information collected in accordance with this Privacy Policy and applicable law, and they accept the risk that security incidents may occur which could affect the confidentiality, integrity, or availability of such information.


11. Careers

The Group may publish job postings and career opportunities within the Group through the Digital Assets, in dedicated pages for this purpose. Personal information collected will be subject to the privacy policy for job applicants, available at: https://dreamjobs.co.il/.


 

 

2. Changes to the Privacy Policy1

12.1 The provisions of this Privacy Policy may change from time to time, including to reflect technological, business, legal, or regulatory changes.
It is clarified that if material changes are made to provisions relating to the use of personal information provided and/or collected about users within the Digital Assets, a notice will be published within the relevant platform of the Digital Assets and/or in this Privacy Policy.
Use of the Digital Assets after such changes are made will indicate the users’ consent to these changes. Therefore, it is recommended to review this Privacy Policy periodically.

12.2. Material changes will be posted, and continued use of the Digital Assets constitutes acceptance of the updated policy.

B. Responsibility for Content and Availability

1. Digital Assets
The Digital Assets, including all content and/or services available through them, are made accessible to users by the Group on an “As Is” and “As Available” basis.
Although the Group makes efforts to present accurate and reliable information on the Digital Assets, the Group shall not be, directly or indirectly, responsible for the availability, truthfulness, reliability, and/or accuracy of the content displayed therein. Reliance on any content presented on or through the Digital Assets is solely at the users’ own risk.

Responsible Use
Users may use the Digital Assets and the content available through them for private and personal purposes only. The site content does not grant any right other than those set out in these Terms of Use, which constitute a binding agreement between the users and the Group. The content presented on the Digital Assets is provided for users’ convenience and personal use only.
Although the Group makes efforts to present accurate and up-to-date information, the content does not constitute professional advice and should not be relied upon as the sole basis for making financial, legal, personal, or other decisions. When making purchases or other actions based on the information displayed on the Digital Assets, it is recommended to exercise discretion and verify the suitability of the products or services for each user’s personal needs.
The Group shall not be responsible for the outcomes of decisions made based on the information displayed on the Digital Assets, and the use of such information is at the users’ own risk. Products, descriptions, designs, colors, or appearances of products and services described or displayed on the Digital Assets are for illustrative purposes only, and differences may exist between what is shown and the actual product. If you identify a significant discrepancy between the actual appearance of the desired product and its display on the Digital Assets, please contact us so that we may act to correct it, at the Group’s sole discretion. In any case, the Group shall not be responsible for any product and/or recommendations and/or offers presented on the Digital Assets.

2. Job Postings
The Group may post job advertisements and career opportunities on the Digital Assets, in designated pages for this purpose. Such postings and their content do not constitute a commitment to hire any applicant or person interested in a position with the Group, nor do they diminish or alter any other recruitment processes that may be conducted by the Group. Job postings and position offers are directed equally to both genders, even if this is not explicitly stated in the posting itself.

3. Data Security
The Group makes every effort and employs advanced technological and organizational security measures to secure the site, its communication channels, and the information under its control against accidental or intentional misuse, loss, destruction, or access by unauthorized parties.
Notwithstanding the above, the Group cannot guarantee complete security and protection of the information, nor can it guarantee that the Digital Assets or their use will be entirely immune from unauthorized access to the information or content stored therein. Accordingly, the Group shall not bear any responsibility in the event of hacking, intrusion, and/or any damage caused by the use of the Digital Assets and/or the content displayed therein and/or related services, whether by the user or on their behalf.

4. Intellectual Property
The Digital Assets and their content, including, without limitation: trademarks, site design, graphics, logos, drawings, data, models, designs, illustrations, music, photographs, images, maps, audio clips, video clips, text, graphics, and the like (“the Information”) are protected by the copyright laws of the State of Israel, international treaties, and the copyright laws of other countries.
All intellectual property rights, including copyrights, trademarks, patents, designs, methods, and trade secrets related to the Digital Assets and the content appearing therein, are the exclusive property of the Group or of third parties who have granted the Group permission to use them.
No commercial use of the information appearing on the Digital Assets, including text, images, illustrations, designs, trademarks, logos, and brand names, may be made without the Group’s prior written consent. Any such use without consent is strictly prohibited and will constitute an infringement of the Group’s intellectual property rights.
It is strictly forbidden to copy, reproduce, distribute, publish, transmit, display, perform, process, sublicense, reverse-engineer, translate, sell, or rent any part of the information by any means without the Group’s prior written consent.
The Group’s name, in all its forms and brands, as well as the names of the sites and applications linked to the Digital Assets, and the domain names of the site(s), are protected trademarks owned solely and exclusively by the Group. The use of or access to the Digital Assets does not grant any license or rights in them.

5. Restrictions on Use of the Digital Assets
Users undertake to use the Digital Assets lawfully and in accordance with these Terms of Use.
It is strictly prohibited to perform or attempt to perform any modifications to the Digital Assets, to copy or download stored material using automated tools such as “Peep-Link,” “Robot,” “PageScrape,” “Spider,” “Crawlers,” or any similar method, algorithm, or process.
It is forbidden to download, copy, or transfer to others any material not intended for download or transfer, to attempt to gain access to transactions made by other users, or to display content from the Digital Assets within a frame (iframe) or in any way that alters their original design.
It is also prohibited to perform any action that may harm the Group’s intellectual property, other users’ privacy, dignity, or rights, or cause damage to the Digital Assets or their users. Violation of these provisions may lead to termination of access to the Digital Assets and legal action.

6. No Partnership
These Terms of Use (or any provision herein) do not create and shall not be interpreted as creating any partnership, joint venture, employer–employee relationship, agency, or representative relationship between you and the Group or anyone on its behalf in any way.

7. Governing Law and Jurisdiction
The use of the Digital Assets and/or any claim, demand, and/or request arising from such use shall be governed solely by the laws of the State of Israel, and the exclusive jurisdiction shall be vested in the courts of Tel Aviv. The substantive and procedural law shall be Israeli law, without prejudice to the Group’s right to initiate legal proceedings in the courts where the user’s address and/or place of business and/or assets, or part thereof, are located, at the Group’s discretion.

8. Severability
If any provision of these Terms of Use is found to be illegal, void, or unenforceable for any reason, that provision shall be deleted, and its deletion shall not affect the legality and validity of the remaining provisions.

9. Account Deletion and Inquiries
For any question and/or request to delete an account, please contact the Group’s customer service via email at privacytx@terminalx.com or via the WhatsApp channel listed on the site, or through the “Contact Us” section of the site.

10. Changes to the Terms of Use
The Group reserves the right to change, delete, and/or add to any of the provisions of the Terms of Use at any time and without obligation to provide prior or subsequent notice. Therefore, it is recommended to review the policy from time to time. If you do not agree to all or part of the Terms of Use, please refrain from using the Digital Assets.

11. External Links
Links that may appear in the Digital Assets to external or other sites are provided solely for convenience. Any reliance on such sites or their content, use of them, or provision of details through them is at the sole responsibility of the user and in accordance with the terms of use and privacy policy of such sites, independently of these Terms of Use.

12. Removal of Content
It is clarified that the Group reserves the right to remove from the Digital Assets any content whatsoever, including the links appearing therein, or to refrain from adding new links, all at its sole discretion.
